("Blue Mar," "we," "our," or "us"), through the Recourse short sale practice (the "Service"), collects, uses, and shares information about you when you use the Service. This Policy applies to information collected through recoursefl.com, the Recourse portal, related communications, and in-person interactions.

Information we collect

We collect information in several ways:

Information you provide. When you create an account, fill out forms, communicate with us, or otherwise interact with the Service, you may provide:

  • Name, email address, phone number, mailing address
  • Property address and information about the property
  • Information about your mortgage, including servicer, loan number, and balance
  • Financial information including income, expenses, bank statements, tax returns, and other documentation required for short sale processing
  • Information about your situation including hardship details and case status
  • Communications with us

Information we collect automatically. When you use the Service, we automatically collect:

  • Device information (browser type, IP address, operating system)
  • Usage information (pages visited, time spent, referring URLs)
  • Cookies and similar technologies (see below)

Information from third parties. We may collect information from public records and third-party sources, including:

  • County clerk records (foreclosure case status, lis pendens recordings)
  • Property appraiser records (property information, ownership)
  • MERS ServicerID system (mortgage servicer identification)
  • Mortgage servicers (with your consent through executed third-party authorization)
  • MLS data
  • Other public records related to Florida real estate

How we use information

We use information to:

  • Provide the Service, including identifying your servicer, opening your portal, and processing your short sale
  • Communicate with you about your case
  • Communicate with your mortgage servicer on your behalf (with your authorization)
  • Comply with legal obligations, including real estate regulatory requirements
  • Maintain records required by Florida real estate licensing law (Florida Statute Chapter 475 and FREC rules)
  • Improve the Service
  • Send service-related communications (case updates, document requests, status changes)
  • Respond to your questions and requests
  • Protect against fraud and unauthorized access

We do not use your information for:

  • Selling to third parties for marketing
  • Sharing with advertisers or data brokers
  • Advertising targeting based on your hardship situation
  • Any purpose not consistent with the real estate brokerage services we're providing

Information we share

We share information only when necessary for the Service or legally required:

With your mortgage servicer. Once you've executed a third-party authorization (TPA), we share information about your case with your mortgage servicer as part of short sale negotiation. This is the operational purpose of the TPA and is required for the work.

With service providers. We use third-party service providers for hosting, document storage, communication, and similar operational functions. These providers are bound by confidentiality and use information only to provide services to us.

With your authorized professionals. If you authorize us to communicate with your attorney, accountant, financial advisor, or housing counselor, we share information with them at your direction.

With prospective buyers and their agents. During short sale listing, standard MLS information about the property is shared with the broader real estate market. Your specific financial information and hardship details are not shared with buyers or their agents.

With closing professionals. Title companies, closing attorneys, and other closing-related professionals receive information necessary to complete the transaction.

For legal compliance. If required by law, court order, subpoena, or regulatory request, we may share information with government authorities. Real estate transactions also involve specific recordkeeping required by Florida real estate licensing law.

With regulators and auditors. Florida Real Estate Commission, Florida Department of Business and Professional Regulation, and other regulatory bodies may request information as part of regulatory oversight.

Business transfers. If Blue Mar Real Estate Group, Inc. is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to confidentiality protections.

We do not sell your personal information to third parties.

Cookies and tracking

We use cookies and similar technologies on the Service to:

  • Maintain your authenticated session in the portal
  • Remember your preferences
  • Analyze how the Service is used

  • Active case information is retained for the duration of your case plus the period required by Florida real estate record-keeping requirements (typically five years after the transaction or last related activity)
  • Tax-related records are retained per IRS and state tax record-keeping requirements
  • Communications are retained per regulatory requirements and ordinary business records practices
  • Analytics data is retained in aggregated form for reasonable periods

After applicable retention periods, information is deleted or anonymized.

If you close your account and request deletion, we will delete information we are not legally required to retain. Some information may persist in backups for limited periods before purging.

Your rights

You have the following rights regarding your information:

Access. You can request a copy of the information we have about you.

Correction. You can request correction of inaccurate information.

Deletion. You can request deletion of information, subject to legal retention requirements.

Portability. You can request your information in a portable format.

Withdrawal of consent. You can withdraw consent for specific uses where consent is the basis for processing.

Complaint. You can file a complaint with applicable regulatory authorities.
